The packaging though wasn’t copied.A fair amount of engagement rings (2,500) at remarkable whole-sale prices has put Costco and a slew of husbands in the dog house, now that Tiffany and Co et al v. Costco Wholesale Corp, US District Court, Southern District of New York, No. 13-01041 has come to a close.

Yesterday, after barring the company from selling any items under the name Tiffany without modifiers, US District Judge Laura Taylor Swain ordered Costco to play $11.1 Million to Tiffany & Co. for trademark infringement, with an additional $8.25 Million in punitive damages for the illegal sale of counterfeit diamond engagement rings bearing the Tiffany name.

Claiming that the name Tiffany has now become a general term in jewelry, Costco maintains that they were not trying to flip fakes and plans to appeal the ruling.Too similar?

At least having been sold by Costco in a brown box as opposed to the Tiffany blue box, when it comes to packaging, Too Faced Cosmetics now is the one being sued by Tatcha under claims that their new Peach Kiss Moisture Matte Long Wear Lipstick looks too much like Tatcha’s 23-Karat Gold Illuminated Lipstick, which according to the lawsuit is, “Causing confusion in the marketplace.”
