Gift giving isn’t without its legal perils. Occasionally, we here at PD make mistakes. For example, there was the time that we thought the American public weren’t dumb enough to vote for Donald Trump.

Now, today for our Genius Idea Friday we’d like to admit to getting it wrong once again.

Back in August of 2013, we suggested that a few bottles from Wine Company Alessandro Lunardelli’s History Line which feature labels of Mussolini, Joseph Stalin and Adolf Hitler would make a great Christmas gift for the fascist on your list.

Today, we know that we should have added the caveat: Only purchase if the giftee does not reside in Germany.Germany, where any mention of Hitler is verboten.

Yes, unfortunately a bar owner in Augsburg, Bavaria is facing charges for having four bottles of wine (supposedly a gift) depicting the Führer on display at his establishment.

Why? Well, Section 86 A of the Stragesetzbuch prohibits the use and/or display of any unconstitutional organizations, i.e. the Nazi Party.

Even the Eva Braun bottle is a no go in Germany.This is the same law that makes saying, “Heil Hitler,” or doing the Hitler salute/goosestep illegal.

In any case, the police received a tip-off about the wine display from a grieved member of the drinking community, and now the owner awaits sentencing which could be up to 3 years of hard time.
